Qualifications for Obtaining Spanish Citizenship if Your Ancestor Resided in Puerto Rico

Spanish citizenship by descent means you can become a Spanish citizen if you have Spanish parents or grandparents. If your parents are Spanish, you qualify automatically. If your grandparents were Spanish but lost their citizenship when they emigrated, you may also be eligible. There are also special rules for descendants of exiled Spaniards and Sephardic Jews with Spanish roots. (Scroll below for an update as of January 5, 2026.)

1. Descent from a Spanish Citizen

  • You must prove that your ancestor was originally a Spanish citizen and resided in Puerto Rico.
  • Provide documentation such as the ancestor’s birth, marriage, or death certificates showing Spanish nationality.

2. Proof of Puerto Rican Residency

  • Evidence that the Spanish ancestor resided in Puerto Rico. This can include residency records, property records, or other official documents.

3. Documentation of Family Lineage

  • Provide a clear genealogical link between you and the Spanish ancestor. This typically includes birth certificates, marriage certificates, and other relevant records showing the familial relationship through the generations.
  • Fulfill any specific legal requirements set by Spanish immigration laws, which may include:
    • Proof of integration into Spanish society.
    • Renunciation of previous citizenship (in some cases).
    • Proof of sufficient financial means or economic stability.

5. Application Process

  • Submit a formal application to the Spanish authorities.
  • Include all required documentation and any additional forms as requested by the Spanish consulate or embassy.

By Descent (Great Grandparent-Grandparents)

The Law of Democratic Memory, which came into effect in Spain on October 21, 2022, expanded the possibility of obtaining Spanish citizenship for the great-grandchildren of Spaniards. This law initially had a validity period of two years, until October 21, 2024, with the possibility of an extension for one more year. The law also allows a great-grandchild and a living ancestor (parent or grandparent) to apply for citizenship together if they reside in the same consular region. This can expedite the processing of applications. 

The application process for Spanish citizenship by descent involves gathering and submitting the required documentation to the Spanish authorities. This documentation may include identification documents, residency proof, language test results, background check certificates, and other supporting paperwork. 

The Spanish authorities typically decide on the application in about two years, but the actual processing time can vary depending on the case. If your application is approved, you’ll be granted Spanish citizenship and may be required to take an oath of allegiance to the Spanish Constitution.

Update: Spanish Citizenship by Descent for Puerto Ricans (2026)

Many people have contacted us asking whether Puerto Ricans can still apply for Spanish citizenship by descent now that the special Spanish citizenship law expired in October of last year. The answer depends on which legal pathway applies to your case.

Below is a clear and updated explanation.


1. Democratic Memory Law (Ley de Memoria Democrática) – CLOSED

The Ley de Memoria Democrática created a temporary opportunity for descendants of Spaniards to obtain Spanish citizenship. This law benefited many Puerto Ricans, particularly descendants of Spaniards who emigrated to Puerto Rico before 1898.

Important:

  • The application window closed in October 2025.
  • New applications can no longer be initiated under this law.
  • Only applicants who secured a consular appointment before the deadline may still be allowed to complete their process, subject to consular approval.

If you did not submit your application or secure an appointment before the deadline, this pathway is no longer available.


2. Spanish Citizenship by Descent (Jus Sanguinis) – STILL AVAILABLE

Separate from the Democratic Memory Law, Spain continues to recognize citizenship by descent under its permanent nationality laws.

You may still qualify if you can prove that:

  • Your parent was a Spanish citizen, or
  • Your grandparent was a Spanish citizen, and
  • You can document an unbroken line of descent using official records.

This process is commonly referred to as “nacionalidad española por opción” or jus sanguinis, and it does not have an expiration date.

Key distinction:

  • Your ancestor must have been a legal Spanish citizen, not merely of Spanish origin or ancestry.
  • Ethnic or cultural Spanish heritage alone is not sufficient.

3. Documentation Is Essential

Applicants must present certified documentation establishing the direct lineage to the Spanish citizen ancestor, typically including:

  • Birth certificates (ancestor → parent → applicant)
  • Marriage records (when applicable)
  • Proof of Spanish citizenship of the ancestor
  • Official translations and apostilles, when required

Each Spanish consulate may have specific document requirements, so verification with the appropriate consulate is essential.


4. Alternative Pathway: Citizenship by Residence

For those who do not qualify through descent, Puerto Ricans remain eligible for Spanish citizenship by residence.

Spain grants Ibero-American nationals, including Puerto Ricans, a reduced residency requirement of only two years of legal residence in Spain before applying for citizenship.

This pathway remains fully open and ongoing.
